collecting debt written off
My debt to Capitec Bank was prescribed in February 2014, As I find out from Capitec it was bought from them by DMC. Recently I have been dubbed to agreeing to pay prescribed debt, I have not made payments to this account from May 2011 until May 2014. From now onwards I do not intend to sign anything or pay anything. If you issue summons, do so at my current address and I will defend the summons based on prescription and ask for legal costs against them. Listing prescribed debt on a credit bureau is specifically prohibited by the regulations to the National Credit Act and any attempt to list me will result in a defamation of character claim against you, of which my name is still listed under Capitec Bank on Experian and Transunion Credit Bureau.<br> If you want to prove that the debt was not prescribed please send me in writing to my current address, I also want proof of debt, the original contract, proof of date of Default, and handover amount and a breakdown of all the costs. I demand that my file be closed and my name cleared from all credit Bureaus.<br>
