Contravention of consumer act

Very disappointed with Discovery vitality, joined the virgin active gym online to then find out I fall outside peak times, I requested they upgrade me so I can go before 8am and they refused, said I have to wait 90days, after i mentioned the consumer act I was within a week from signing up and legally I can cancel or change they still refused, after further complaints i was told they will get back to me and never did!!! Such contravention to the consumer act!!
