Complaint: Apple Watch

<p>Dear Vitality Review Team (no name given)</p> <p> </p> <p>Once again I’m very disappointed as it seems like The Vitality Team is not reading nor listening to the clients’ request as well as the demand and expression of the situation. It is quite sad because from what I am reading it seems as if it is all about ‘money’ and the human rights factor is not considered. I have explained this and I have attached my proof again for the 5th time even after explaining it numerous times.</p> <p> </p> <p>The following is attached:(alrad send formal email on 13 April 2017)</p> <p>The agent (a woman) who communicated with me did not explain anything about targets or costs related to the watch. I asked if there was anything related to the watch that I am going to pay for and she said no. NO explanation regarding the WATCH. She was clear as you can see in the attached document.<br /> </p> <p>In July 2016 and August 2016, I then discovered the debit order on my account. I sent several emails to enquire about what was going on as it is my hard earned money that is being debited. Discovery has no right to do that. I am not STUPID and would not agree to such a thing if it wasn’t explained.</p> <p> </p> <p>In October 2016, I went to the Discovery Store in Seapoint and met with the manager in store. He was extremely rude and not helpful at all. Ever since then I have been waiting for emails and have received many reference responses after I emailed Discovery. However, the cost has now accumulated and affecting my credit, is that FAIR???</p> <p>It is only on the 9th March 2017 that I was able to get a meeting at the Discovery Seapoint Store. I brought my South African Sign Language Interpreter (SASLI) along with me. The reason for that is because I am a Deaf person and I need to be clear on what is going on. It was only then that I was told about the targets and if I don’t meet the target that’s when my account would be debited. I have desperately been trying to reach the targets, as you can see on my record, however it is difficult to do so due to my work and travelling situation. As a result of this I am not reaching the full target and my account is still being debited.</p> <p> </p> <p>If I received full information about the watch from the point of sale, I would not have accepted the offer. My job title and capacity thereof doesn’t allow me to sit in the office all day. I have to see to the needs of unsatisfied clients without delay and their needs are of the utmost importance. It seems like Discovery don’t share the same views for their clients.</p> <p> </p> <p>If this continues to be ignored or remain unresolved, I will be taking this further and taking to social media to show the society that I have received UNFAIR treatment and I have never encountered such treatment before with any other companies. My rights have been violated in a manner that is completely unacceptable.</p> <p> </p> <p>Point is that the terms and conditions of this deal was not explained or elaborated in full at the point of sale and also to add that my first language is SASL (South African Sign Language)</p> <p> </p> <p>Yes I’ve signed the contract however when discussing the terms of the watch with the agent I asked whether there was a cost related to the watch, she assured to me there was no cost. Trusting in her word and information I signed the contract. There was no full explanation made regarding targets or cost relating to the watch, this counts as a mislead sale. The agent omitted important information with the hopes of making a sale.</p> <p> </p> <p>I have done some research on this matter and this is what I have found: </p> <p> </p> <p>The South African Consumer Protection Act, No 68 of 2008</p> <p>As a consumer you have certain rights and you must know your rights and consumers should be aware that they are entitled to enforce their rights. The consumer protection act and the Bill of Rights allow consumer certain rights and these include the following:</p> <p>Right to privacy.<br />Right to choose your product.<br />Right to fair and honest dealing.<br />Right to disclosure of information.<br />Right to fair and responsible marketing.<br />Right to accountability by suppliers.<br />Right to fair value, good quality and safety.<br />Right to fair, just and reasonable terms and conditions.<br />Right to Equality in the consumer market and protection against discriminatory marketing<br /> </p> <p>4) RIGHT TO DISCLOSURE OF INFORMATION</p> <p> a) Right to information in plain and understandable language.</p> <p> Consumers have the right to demand agreement, contracts and other documents in a plain and understanding language.</p> <p> </p> <p>3) RIGHT TO FAIR AND HONEST DEALING</p> <p> a) RIGHT TO ASSUME THAT SUPPLIERS ARE ENTITLED TO SELL GOODS</p> <p> It is a consumer’s right to assume that the supplier have the Legal right to sell the products and goods on promotion by the supplier or that the lessor have the authority to lease goods or products.</p> <p> </p> <p>On top of all that, I chose Discovery because of the good marketing and history. I have joined the medical aid and have been very satisfied because I was given a full explanation on everything which I clearly understood before I signed the contract/agreement. I have had no problem with this since joining however since getting the Discovery credit card and being told the Apple watch is free.. This was a bad consultation.</p> <p>The Review Team itself, no names, no signatures, no details are ever provided as to who is in contact with me via email. It is like a call centre which I find unprofessional.
