CLAIM PAYOUT DELAY FOR INCOME CONTINUATION BENEFIT

My mom was in an accident Feb 2018 and was injured badly, she underwent 3 back operations in a 7 month period. Her employer stopped paying her in May 2018. Her employer submitted her claim October 2018. Discovery required additional reports, she comp**** and by November she went to all the Discovery appointed Neurologist and Occupational the****** as requested. Almost 2 months later and no feedback she started to enquire on the status of her claim she was told that the Neurologist report is still outstanding. Please keep in mind that Discovery appointed the Neurologist and never followed up on the report, or notified anyone that the report was still outstanding, the report was to be sent directly to Discovery, therefor she had no knowledge if the report was sent or not this delayed her claim with months, she was just told that her claim could only be assessed after they receive the report, after a lot of phone calls and mails the report was eventually sent. The claim was eventually approved. However she is still awaiting the some kind of indication on how much they will be paying out or when. Since 8th February she has been following up every day with her employer if they received any kind of information, she was notified that maybe they will have information regarding the amount and date of pay out by end of March. This is not right, I feel Discovery was at fault not following up on the report and delaying the claim, my mom does not deserve to be penalized because of their mistakes she did everything they asked and on time. My mom is a single mother of 5, she has not received a salary since May 2018. She has fallen so behind on all the bills, there is not enough money to buy food at this stage and she is sending my siblings to school without lunch we are currently been evicted out of our home if payment on outstanding rent is not payed within 3 days. Discovery needs to take their client’s needs into consideration. I feel that Discovery should at least try and fast track her claim and process it as a matter of urgency with no further delays.
