Zero excess becomes R3000

On 21/01/2016 I had an accident and lodged the claim on the same day. On 29/01/2016 I got confirmation of the claim. I noticed an excess amount. When I took this policy out I was told should I claim and the accident is not my fault the excess is zero. I called the claims department and I was advised the matter would be referred to a legal consultant whom would write-off the excess. I received an email from a legal consultant requesting details of the truck driver. I mailed her the details and asked to write-off the excess. Later the claims consultant contacts me advising that only once Discovery gets the monies from the driver will they write-off the excess and if this does not happen before my vehicle is repaired I will need to pay it. I refuse to pay this excess. By 5/02/2016 I received no feedback and sent a follow-up email. By 8/02/2016 I received no further feedback. I sent an email another follow up and received a call. She advised she sent feedback on the Friday but I never received it. She then forwarded me the mail but it was only a progress update with no mention of the excess being written off. I responded to the email requesting that the excess be written off.

Hello RAP,

While we appreciate that you refuse to pay this excess, it is important to note that repairs are initiated by the payment of excess.

Kindly note with regards to excess; despite a third party involvement, excess remains the portion of the amount you must contribute for your claim to be settled. Whilst we have a benefit for waving the excess when the third party is at fault, the following terms are presented with it: DQ-Track fitted to your motor vehicle & Discovery Insure legal team confirming that the third party is at fault. This is in section 7.3.9 of the plan guide.

Until our legal team confirms that the third party is a fault, excess is your responsibility. This will be refunded should the third party admit to fault.
