Unfair Excess Demand and Poor Service on Claim ***

On 1 October 2024, my son’s vehicle, insured with Discovery Insure, was T-boned by a minibus taxi in Cape Town. This was a clear no-fault incident, supported by comprehensive evidence (police report, witness statements, and the at-fault driver’s license and vehicle registration details) submitted with claim ***.

Despite our driver being 100% not at fault, Discovery Insure demanded a R5,500 excess to process the claim. When queried, they stated this is “normal practice” and that they would attempt to recover the excess from the at-fault third party. This was communicated in a dismissive, lackadaisical manner, suggesting little confidence in their recovery efforts. As policyholders, we provided all required evidence to facilitate recovery; it is Discovery’s responsibility, not ours, to pursue the at-fault party through their legal department.

Six months later, we have received no updates on the recovery process, despite Discovery’s promise to follow up. This lack of communication and apparent inaction is unacceptable. It leaves us, the innocent party, financially burdened for an accident we did not cause. Discovery’s approach feels profit-driven, prioritizing operational efficiency over fairness and customer service.

In contrast, other insurers like OUTsurance handle not-at-fault claims with greater transparency and customer focus. I urge Discovery Insure to refund the R5,500 excess immediately or provide a detailed update on their recovery efforts. I also advise consumers to consider alternative insurers who prioritize fairness. My experience with Discovery Insure has been deeply disappointing, and I expect a prompt resolution.

I’m glad you’ve acknowledged my frustration, but I’m disappointed that your reply doesn’t tackle the heart of my complaint or show any real progress on my claim. I’m determined to see this through fairly and openly until it’s resolved properly.
Your first update, which only came after I posted my review here, mentioned a single phone call, an SMS, and a WhatsApp message to reach the third-party driver and owner. With no dates or follow-up actions provided, these steps feel far too lightweight to hold someone accountable—especially when you have photos proving the taxi was involved. Your latest response mentions your legal team’s “active involvement,” but it’s vague. What exactly have they done? Have you checked the owner’s details through NaTIS? Have you confirmed the vehicle’s operating licence with the Provincial Regulatory Entity? Have you considered legal steps against the owner, who, under South African law, is responsible for the vehicle?
This is a minibus taxi, regulated under the National Land Transport Act of 2009. The owner needs a public operating licence, and the driver must have a Professional Driving Permit—both of which can be traced. If the owner denies any involvement and the driver’s unreachable, as you’ve said, that’s a red flag. Could this be a cloned vehicle? These aren’t minor issues; they demand serious investigation, not just a few messages.
I’m asking for the following within 7 business days:
  1. A full breakdown of what you’ve done so far, with dates and results (e.g., NaTIS checks, PRE contact, any legal letters sent).
  2. Proof that you’ve verified the vehicle’s registration and operating licence—or a commitment to do so immediately.
  3. A clear plan to step things up, like sending a formal demand letter, issuing a summons, or involving SAPS if there’s a chance the vehicle’s details are ****.
I’m open to working with you constructively, but I won’t let the process wear me out. If I don’t see meaningful progress, I’ll escalate to the Ombudsman for Short-Term Insurance (OSTI) or other authorities. All I want is a fair outcome, and I trust you’ll step up to meet your responsibility to pursue this claim properly.
