Third Party Liabilities Insurance Claim Nightmare

I am very disappointed by Discovery Insure and the advisor Ofentse Menyatso. Their Third-Party Liabilities claim process is a nightmare and it's not a priority for them. Communication from the advisor on the progress of the claim is very poor and in fact very frustrating. They deliberately delay the claim process and they will wait until the very end only for them to reject your claim based on unrealistic/weird reasons. You send them several emails and call them but no one in that department seems to take you seriously if you are claiming for Third Party Liability, yet you have a vehicle that is waiting to be repaired after being bumped into by their insured client.

Your reply is just a repetition of the same problem that I highlighted on my complain and does not help me. What do you mean when you say your client was turning, it sounds very shallow response coming from you as an insurance company? Have you had a chance to look at the sketch of the accident details at the site that I sent you that shows that your client failed to stop at the stop sign whilst I was in motion along the main road and she ended up hitting on the side of my car? Does that have to do with her turning, and is it my responsibility to ensure someone stops at the stop sign, or she is simply supposed to follow road rules? Please be serios with the way you deal with this issue as it seems you are simply finding way of avoiding a payout, for an accident that even she knows that she caused it herself on that day. I am surprirsed that you even mention the fact that I am supposed to pay for this on my own, getting the funds from where?

The outcome is definitely unfair on my side considering what happened during the accident, of which the details I clearly outlined on the claim form. You will obviously find loopholes for you to deny payment for the third-party claim, while on the other side the person who bumped into me seems to also have came up with a fictitious story. I am not in agreement of your statement that says "As per South African law, both drivers share a responsibility to ensure safe driving practices. This includes keeping a proper lookout and driving at a reasonable speed regardless of whether they have the right of way. In evaluating the claims, we assess the actions of both drivers at the time of the accident". The bottomline is that the driver who hit my car failed to stop at the stop sign and there is no way that I way I going to predict that she was not going to stop at the stop sign.
