still trying to sort out flood damage since July - worst car insurance ever

With the floods that happened in July 2016 I logged a claim with Discovery Insure - ********** and after fighting with discovery Insure, after BMW umhlanga technicians told the assessor that the car should be written off, I agreed to take back the car after a very reassuring call from Sakhe at the excecutive office of Discovery Insure. Sakhe personally assured me that should this car ever be problematic after this repair he will accept full responsibilty thereafter. I even asked him for this assurance in writing and was told that the call was recorded so this was assurance enough.

A week after I accepted my car, I had to have BMW tow the vehicle as the car was non-driveable due to a fault. At this point I was under the impression that this fault was due to normal wear and tear of the vehicle. The vehicle was repaired under the motor plan and returned to me.

A week or so after that the vehicle once again broke down and was once again towed into BMW. When the technician at BMW had a look at the vehicle, he informed me that all these faults will now appear due to water in the vehicle and there is no way of establishing how far the water has gone.

The vechice was towed on 19 November and my wife logged a call with Discovery Insure as I was overseas. She informed the consultant that the car was towed in and requested an assesor to be sent to BMW.

Heres my frustration:

1. BMW has informed me that to date no assessor has come to see the vechicle its been there since 19 November 2016.

2. Discovery claims that BMW had a policy that stipulate that around the first claim the car could not be written off as per BMW policies. BMW states that there was no such policy and the car should have been written off like all the vechicles that came in that day because of flood damage. Point to note is that my car was the only one not written off despite the fact that the recommendation from BMW was to write the car off.

3. Sakhe, to date has not returned any of my calls, nor answers his phones and has obviously retracted or even maybe **** to get me to take my car back after the first claim. He very conveniently calls after the first claim makes promises and assurances and then never ever accepts the responsibility like he promised. No one from the exceutive office wants to return my call or look at my case.

4. I have called so many times, explain my story to each consultant and they promise me that someone will get back to me. My case manager Cynthia is non existant, does not return calls and doesn't even take my calls. At any part of the day she is never available so thats a dead end.

5. The car has been at BMW since 19 November and to date NO ONE from the assessor's team has gone to see and assess the car.

Since the flloods on 25th July I have only driven my car for about a week. I ask you why am I insured with Discovery Insure who claim to be a premuim insurance company.

I am really frustrated and want immediate answers and action from Discovery!!!!!!

If I don't get answers from Discovery, I will be seeking legal advice as I have been without a vehicle for almost 6 months and I have been advised that I have a valid case to take to the ombudsman.
