Refuted my VALID 3rd party claim
I laid a 3rd party claim as your client was negligent when she knocked into my vehicle and my claim was refuted with an excuse that more liability falls on the vehicle who is reversing. I then emailed the below with pictures of your client facing oncoming traffic which is an ******* traffic infringement but to date still no response from my email. Since when does an ******* traffic infringement not equal NEGLIGENCE!
Your reference check clearly proves you have not done due diligence as I have 2 witnesses who can confirm the negligence was on your clients part. Please note the following:
1. Your client drove into oncoming traffic toward a vacant parking which I was already parallel parking into before she arrived. (See attached picture clearly indicating your client facing oncoming traffic) Please refer below.
"3) The driver of a vehicle on a public road divided into traffic lanes by appropriate road traffic signs shall not turn from one lane into or across another lane unless he or she can do so without obstructing or endangering other traffic." https://www.arrivealive.mobi/Rules-on-the-Road#part1_1
2. Your client drove into me making contact while trying to dodge oncoming traffic forcing her way into the parking bay. 3. I have a right of way to parallel park. 4. The petrol attendant from the Garage came across and notified us that he witnessed the negligence by your client and is willing to stand as a witness. 5. Your client tried to flee from the scene before being stopped by my husband and the petrol attendant. This in itself is ******** and dishonest.
"Don’t make the mistake of assuming it’s okay not to stop after an accident that isn’t serious. Failing to pull over counts as a “hit and run” and is a ******** offence, even if nobody is killed or seriously injured in the accident." https://www.arrivealive.mobi/Legal-Duties-after-a-Road-Crash
6. If this is the way you deal with business with no integrity then I will be sure to make it known.
Your client agreed to making the mistake and took full responsibility and advised she did not check that I was clear before driving across lanes into the parking space; now you are waivering responsibility after the fact.
I am appalled by the nature of your business dealings.
