Query about a request for a courtesy car

<p>I insured my car with Discovery Insure in 14 June 2017.</p> <p>On sunday the 2nd July 2017 my daughter who was driving my car was in involved in a minor accident. The guilty party was speeding while approaching 2 other cars infront, mine being infront of his. As he was speeding, two cars infront were slowing down as they were approaching a speed hump.</p> <p> As a result, because the guilty party's car was too close for him to stop when my daughter app**** the breaks at the speed hump, he smashed the rear side of my car. </p> <p>I reported the acident with Discovery but indicated that I will not claim the damages , instead the guilty party will settle it with his cover(he is also insured with discovery).</p> <p>Discovery requested that I take the car for assessment which I did. I was told by the panel beater that he will forward the results to discovery in the next 2-3 days. The panel beater indcated that I will have to bring the car sometime next week 7-11 July 2017 for repairs. They also indicated that it was going to take them up to 8 days to repair the car.</p> <p>I then inquired with Discovery regarding the provision of a courtesy car during that period since my job requires that I have my own transport.</p> <p>Discovery indicated that a hired car is only provided when a claim is processed through the insurer's policy. Since I also submitted a claim to Discovery but indicated that the damage will be paid by the guilty party . Discovery responded that they cannot assist me in that regard and that I should withdraw my claim , which I intend to do.</p> <p>My question is, why is it that I will not be provided with a courtesy car while my car is being fixed and the quilty party is to be offered a car when he caused the accident in the first place. It does not make sense to me that I am left stranded due to an incident which neither my daughter or I caused.</p> <p>I refered to the policy which was silent about those conditions and only indicated that I will be provided a courtesy car up to 30 days.</p> <p>It doesn't make sense to me . Can you assist me in terms of the law and my rights because it I do not understand.</p>

As discussed, we unfortunately cannot offer car hire as you have opted to log a 3rd party claim, however the car hire benefit is available in the event that you have logged an insurable claim through your insurer.
