Letter of Demand for Ridiculous Inexperienced Assessment

Dated 05 July 2023 Discovery Insurance Subject: Letter of Demand - Claim Number *** Dear Sir/Madam, I am writing to you in regards to my claim with Discovery Insurance, Claim number ***, which has been unjustly repudiated. I am extremely disappointed with the decision to deny my claim based on the grounds of "Wear & Tear or Mechanical Failure," as this is completely unfounded and contrary to the facts of the incident. The incident in question involved a Heavy Engine Lifter Accidentally Jamming into my Garage Door Resulting in Severe Damage to Garage Door, Winding Spring & Motor been Damaged, I would like to Emphasize that this was a Purely Accidental Occurrence and was Beyond my Control. The Assertion that this Damage is the result of Wear and Tear or Mechanical Failure is both Nonsensical and Contrary to the Evidence at Hand. To support my claim, I have obtained an expert assessment and Damage Report, which clearly states that the damage sustained is a Direct result of an accident, rather than any pre-existing condition or mechanical failure. This professional assessment reinforces the fact that my claim is Legitimate and should not be Repudiated on Invalid grounds, this can be verified with " LA Afrika Contractors whom also gave a Written Damage Report and Quotation" Discovery also sent out Their Own Independent Contractor as well Whom also had been shown the Heavy Mobile Engine Lifter on site which Led to the Accident that occurred, Pictures are available from them as well Furthermore, I would like to draw your attention to the recorded conversation I had with a Discovery representative during the Submission of claim. I explicitly described the incident and its accidental nature, leaving no room for ambiguity or misunderstanding. It is disheartening that my account of the incident was seemingly disregarded or Purposely overlooked during the claim assessment process. I Explained I was working on my Car in my Garage using an Extremely Heavy Mobile Engine Lifter which got Jammed at the Bottom of the Garage Door that led to the Damages concerned, the High Tension Winch Spring Snapped and with the Severe Impact caused Immediate Damage to the Motor & other parts etc. I even Explained same to Discovery Assessor & all parties concerned, However Discovery Assessor told me this is Mechanical Failure and they don’t cover Mechanical Failure. To my Surprise I am even now been told its Wear & Tear, This is Absolutely Unacceptable I hereby demand an Immediate reconsideration of my claim and a fair and unbiased review of the circumstances surrounding the incident. The evidence clearly indicates that the damage is a result of an accident, and I expect my claim to be processed accordingly. It is crucial that you rectify this situation promptly and provide a favorable resolution that aligns with the principles of fairness and justice. Failure to address this matter appropriately and honor the terms of my insurance policy may compel me to take further action to protect my rights as a policyholder. This could involve seeking legal counsel and reporting the matter to the relevant regulatory authorities. I trust that you will handle this matter with the utmost urgency and conduct a thorough review of my claim based on the evidence & pictures provided by all assesors concerned even myself can provide such. I expect a comprehensive response addressing the validity of my claim within 7 business days from date of this letter. Additionally, I request all Recordings, and full investigation Reports from Discovery Independent Contractors who have been onsite Their Contradictory Views as to this Nonsensical biased Decision will also need to be Personally Questioned & Testify in any Judicial Forum regarding the Above Claim. Additionally you provide a detailed explanation for the initial denial and outline the steps being taken to rectify this unjust decision. Please acknowledge receipt of this letter and provide me with the necessary contact information of a designated representative who will be responsible for handling my claim moving forward.
