Discovery Claim of motor vehicle Kia Rio 1.4 tech 2014 model – Reason for rejection is that car is not roadworthy - Service history the car is up to date with the service last being the 120 000 km in October 2018 and no major issues were noted next service was almost due at 135000km - The car was taken for an annual inspection at tiger wheels and tire in Midrand on 02 July 2018 and the inspection came up as a pass with option to replace tires in order to reinstate the insurance policy the spare wheel was deemed fine - Car also went for a second inspection in Discovery building in Sandton when we were installing the DQ track on my car again there was no issue - I bought 2 new tires in November during black Friday 2018 from Malas to specifically replace the front tires as my car is a front wheel drive, I then took the tires to a professional who deals in selling and replacing tires in Soshanguve at a reasonable price to install the tires in the rims - One of the rear tires hit a pothole around February/March 2019 that it was damaged a road side assistant mechanic hired by discovery came to assist and replaced the tire with the spare wheel - Car has been stopped on a few road blocks and no issues were noted - Car gets into an accident in early hours on a Friday on 23 March 2019 and a claim was lodged where an investigation was done to determine if I have a valid claim (a) Assessment of bank statement for irregular expenditure (Alcohol or drugs) None (b) Assessment of story of accident checks out (c) State of Vehicle End result is that car is not road worthy because rear tires do not meet minimum thread and front tires were incorrectly fitted – why was this not noted on road blocks and on service of vehicle - I also did an investigation to see if I was negligent to checking for road worthy (a) Public transport cars need to go for a roadworthy test on an annual basis (b) Cars carrying goods of more than 3000gvm and busses need to go for roadworthy test every 6 months (c) If a person is in the process of selling the car they need to make sure the car is road worthy before the transfer (d) Owner of the car also needs to check if the car is roadworthy whenever there is any indication that it is not roadworthy - I have been driving this car for more than 4 years including 6 months after its last assessment with no issues however when it gets into an accident suddenly, I am negligent - After they had agreed for me to send a settlement letter they hire a lady who seems like she’s in it to make a life of a black male professional miserable Lindsay Lodewick by making sure no claim is paid out, she looked for all possible means not to pay. - I have made it a point to fight against this ************** by taking discovery to court and challenge their outcome
