Discovery wasting time and costing me my Excess
I had an accident on 15/06/2019, a driver rear ended me while I was standing still. I got all the details of the driver, and opened a police file just as advised by the insurer. They also advised not to contact the other party as they will be taking legal action to retrieve the monies as it was the other parties fault. It has now been several months and the only response I got was when I explicitly contacted them to find out what was going on. Now the latest response is that they cannot contact him and will not be paying my excess back, even though I was clearly not at fault. They also advised me I can go after it myself via small claims court now, but after all this time has been wasted by them, how would I have any chance of getting anything from the other party.
So basically they wasted a lot of time after an accident to get money back from the other party, now leaving me without my money or a lead as the other party has had plenty of time to get away..
Unfortunately, even though we do everything in our power to try and recover the repair cost and your excess, this process can never be guaranteed. In respect of your rights and our duties to recover our damage and your excess, we need to emphasise that your excess is the first amount payable in the event of a claim, irrespective whether the reason for your claim was as a result of someone else's negligence or not.
