Discovery third party claim.
Good day
I would like to seek assistance on the following matter. December i was involved in an accident, whereby a bakkie drove into a Discovery client that ended up colliding into my car. The driver of the car that bumped into me is a discovery client and employee of them. She promised me that her insurance needs to pay for the damages(as an assessor and employee) and after going true the entire process,discovery decline my claim,due to the fact that there client was in the middle. The consultant who assisted with the claim gave me the following reason-
"According to the information at our disposal and the description received our insured was not the negligent party.
We wish to point out that a person in your position must act reasonably when a collision seems imminent. The duty of a driver is to take all reasonable steps to avoid a collision by either:
1. Keeping a proper lookout
2. Traveling at an appropriate speed
3. Having control of his vehicle"
That is a direct acetract of the email.
I am still with a boot that are damaged and i feel this is not fair,as i was stagnant and your client ended up in the back of my car.
The discovery client's car is fixed and running, while i have to drive with a car with a boot that is broken and cant open properly.
Please if anyone have advise, advise accordingly as i don't have insurance and this will have to come from my pocket in this difficult times....
