discovery settles claims within 30 days ... if they feel like it

i was in a motor vehicle accident on the 3rd of July. a lady insured by discovery bumped in to me and admitted that the accident was her fault. she told me not to worry because her insurance, Discovery, would sort my car out. on the 11th of July Discovery confirmed receipt of my correspondence , all the documentation they had asked for, which included a no claims letter from my insurance. i was foolish enough to request the no claims letter from my insurance thinking discovery would sort it out quicker if i did what was requested of me. on the 12th of July Discovery emailed me telling me that the claim will be settled within 30 days. as requested i then took my car for assesment on the 13th of july, the assessor told me discovery should contact me within 48 hours. i had gotten no feedback from discovery to even say that they acknowledge i took it for assesment so i tried calling the person assigned to handle my claim but my calls were not answered. on the 19th i emailed asking for some information regarding the status of my claim. i again received no feedback. a week later after more failed phonecalls i emailed the consultant handling my query again on the 25th of July wanting to know what was going on and why it was taking so long. in this time i also contacted the lady who bumped me and she said she didnt know why they were taking so long. she suggested that instead of calling again, that i should email discovery. so once again, on the 3rd of August i emailed discovery asking about the status of my claim. this was already 1 month after my accident. still, no response. i tried my luck again the following week and this time the consultant actually answered. he gave me an appalling reason for why it was taking so long stating that he was having trouble contacting his client, the lady who had bumped me, funny as i had contacted her with ease throughout this process. eventually on the 19th of August i received feedback. they sent me a quotation of what it would cost to fix my car which was over R11000, but they are only willing to pay me out R6245.83. this because of some bull**** they worked up at discovery called "contributory negligence" which my legal advisor has told me they will have to prove in court. after waiting for almost 2 months for this matter to be solved i will not be entertaining their joke of a settlement.
