Discovery Insures new fire risk assessment on old policies

Discovery Insures new fire risk assessment for all houses with a thatched roof in Partnership with Danatifire. At the commencement of policy *** Discovery Insure was aware that my roof was thatched, and this has not changed and therefore cannot be considered as a "material change in risk" as this risk always existed and was accepted by the Insurer. The cover for the property through Discovery Insure commenced in 2019. It was clearly stated that the house had a thatched roof. Since 2019 until 1 October 2025, Discovery Insure, I had not requested any inspection or assessment regarding the thatched roof. At the commencement of the policy Discovery Insure made no stipulations regarding additional requirements needed beside a lightening conductor. There was no mentioned of any fire standards which needed to be comp**** with or structural, material, or environmental enhancements or changes prior to the acceptance of cover. Based on the Principles of Fairness and Consumer protection - South African courts emphasised that insurers must act in line with the principle of “treating customers fairly” as Discovery Insure are imposing new requirement this would amount to an unexpected and unfair change in my contract, policy in requiring these additional costly measure and potential rewriting of my risk assessment. I would further argue that no requirements were in the original document, and these new changes have been imposed and enforced retrospectively. I have been insured with you for six years with the understanding that no such assessment requirement was needed; the new requirement was not part of the contract when I first took cover, and I was not sufficiently informed of the change in a clear, transparent way. Discovery Insure is ensuring that its client bear the cost and inconvenience solely because they have a thatched roof a risk which has always been known to them.

Thank you again for reaching out to us and please accept our apologies for the delay in response.

We appreciate that you’re not happy with the upcoming fire risk assessment changes to our policies related to thatched roof risks. You believe that these changes are not in line with our principle of “treating customers fairly” and that for the 6 years you’ve been with us, we’ve been aware of your thatched roof and have never required such an assessment. Also, that you believe you were not sufficiently nor clearly informed of the change and that you would have to bear the cost and inconvenience.

It is precisely because we are aware of your thatched roof that you received notification of the upcoming changes. Had we not known about it, you would not have been included in these notifications, and your policy would have carried on as per usual. We never informed you of these changes when you started your policy 6 years ago as we weren’t aware we would be making them, nor requiring these assessments, at the time. We cannot advise you of something if we do not know that it is coming. However, in our Plan Guide, which forms part of the contract that you agreed to, Section 5, 5.1 Amendments, provides that “We may amend, endorse or limit cover in terms of your plan at any time by giving you 31 days’ written notice. Any changes you make will be effective from the time and date agreed to.”

We still haven’t requested that you make any changes to your risk, all we have requested is that you allow access for Danati Fires to complete a free assessment of your property. They will compile a detailed report for us to review. Based on this report and our review, we may recommend certain remedial actions if compliance standards aren’t met. These requested changes will be made in writing and in advance of the 31 days notice period.

How are you treating me fairly- force me to get an inspector to review my property, tell me I need to make R200k in changes to be compliant within 30 days and if I can’t afford to or don’t do it then you will load my premiums and that’s treating customer fairly. Hide behind you Ts and Cs. Rather just say you don’t want to cover a thatch roof. Well I made it easy for you I moved my insurance to Momentum, going to be moving my company and employees away, next step will be to move my other products, cause I have no value to Discovery. This isn’t the Discovery I use to work for.
