Discovery insure trying to avoid paying full
On the 15th of Jan Someone bumped into my car from the side and then claimed full responsibility for the damage.
I went through the process of claiming third party damages from his insurance which is discovery.

After over a month of waiting they get back to me saying that they will only be paying 70% of the amount given to them by their assessor.

How is it that the victim in an incident is liable for someone driving into his car from the side even after doing what could be done to limit the damage by trying to swerve away in a driveway with not a lot of space to maneuver a car.

I was already out of my office parking lot gate after having checked that the next gate had no car there and then this guy comes speeding out and not seeing my car. He claimed full responsibility for the damages and as said his insurance will take care of it. However this is now apparently not the case.

If I knew this from the start I would have just claimed from my insurance but now I am stuck because the insurers do not want to pay out and I needed a claim withdrawal letter from my insurance before I could proceed with the third party claim.

There is no justice being done here.
