Discovery Insure Third-Party Claim: Why Should the Innocent Party Pay the Difference?

I am extremely disappointed by my experience dealing with Discovery Insure as a third-party claimant.

After being involved in an accident caused by a Discovery Insure policyholder, I followed Discovery’s process, submitted all requested documentation, and obtained a repair quotation from Sandton BMW Approved Repair Centre.

BMW ARC assessed the repair cost at approximately R39,757.70, excluding any hidden damage that may only be discovered once the vehicle is dismantled.

To my surprise, Discovery then offered a cash settlement of only R24,528.09.

That leaves a shortfall of more than R15,000.

What I find difficult to understand is why I, as the innocent party, am expected to carry the financial burden created by another driver’s negligence. If BMW ARC says the repair will cost approximately R39,757.70, who exactly is supposed to pay the difference? Aren’t they suppose to put me in the same financial situation I was in before the incident? Because clearly if I have to pay money then I am the compromised party here.

Even more frustrating is the fact that the rear bumper damaged in this accident had only recently been replaced during a previous insurance-authorised repair. The vehicle had already been repaired and restored before the Discovery policyholder damaged it again.

I formally rejected the settlement offer and provided Discovery with a detailed explanation of my concerns, reduced repair allocations, they stated that I should take the car to Sandton BMW but they don’t want to pay for everything and the fact that the offer falls significantly short of the BMW Approved Repair Centre assessment.

To date, I am still waiting for a satisfactory explanation as to how Discovery believes a settlement of R24,528.09 will restore my vehicle to the condition it was in immediately before the accident.

My concern is not only about the amount. It is about fairness. As a third-party claimant, I have discovered that dispute resolution options are limited, leaving ordinary motorists with very little protection when they disagree with an insurer’s assessment.

I hope Discovery will reconsider its position and provide a fair resolution. Until then, I believe motorists should be aware that accepting a settlement offer without carefully reviewing the repair assessment could leave them paying thousands of rands out of their own pocket for an accident they did not cause.
