Discovery Insure - Putting the "lie" in liability.

Still waiting for Discovery Insure to resolve my 3rd Party Claim from 2017....And yes before you get excited, I know you have 3 years by SA law to resolve it....

However, your current argument, as to why it is unresolved, is because your company states another party jumped a STOP STREET ON THE N1 and hit your client first.

He hit her. She was in her lane. I saw it through my mirror with my very eyes (so did the other 4 witnesses in the police statement).

1 vs 4 and you tell me I haven't been able to fix my vehicle for over a year because there is a stop street on the N1 at Plattekloof in the Western Cape....I assure you, there hasn't been a stop street on that section of road since I've been alive.

YOU HAVE ****, your client never stated anything about a stop street anywhere, including the police report (which I have a copy of).

Do the math here, we were stationary in traffic, your client was moving rapidly on a motorcycle straddling lanes (yes I know that is legal, but reckless driving is not), he hit me in the rear ON THE HIGHWAY, no stop streets present and I WAS STATIONARY.

It doesn't take a lawyer to see who is liable, it does take one to make a dismal attempt at avoiding your own liability though. Rick Van Tonder is liable. (hope you find this in a Google search someday Rick, remember admitting you were at fault and then changing your story the next day?? That caused me a year of agony that I hope you will someday be able to understand).

I've added the claim number, please don't put me in touch with Robyn Job again.

The cost of damages is petty change for Discovery, it is livelihood for me though. Zero compassion from a business profiting off of fear and negativity...

Please resolve asap.

Anyone else reading this that would like to contact me for more details or to verify everything mentioned above, I have tonnes of paperwork and email trails documenting this all (I just don't have the time to go to lawyers...YET), please reply below.

Ever since I found out about the stop street story, you have stopped mailing me refuting liability. I imagine this shows you are aware of a very serious error somewhere, an error which has resulted in me needing to spend hundreds of, and I'm not joking when I say this, hundreds of hours of my valuable time, trying to resolve the outcome so that my vehicle is repaired. How is this fair? Why are you not investigating the claim??? If you investigated you'd never mention anything about a stop street. Proof that nothing was done for over a year. No investigation from your side into my claim or better yet, the legitimacy of your client's statement and his 1 witness statement (vs 3 opposing in the police report). A witness who has not been in contact with any other party than your client, did not stop at the accident scene, and, if I recall correctly, is also a lawyer by profession... Please investigate this properly, or at least to the point where you realise a National road with 4 lanes and a 120km/h speed limit cannot have a stop street. I'd prefer my feedback on this platform please.

If anyone reading this is curious as to the outcome, here it is: “Without Prejudice” Good day Iain, We have now had the opportunity to look into the matter and our stance remains. I considered your argument and do not agree that the substantiation as you provided is proof that our client was the cause of the accident .We have discussed the matter with our client and confirmed the incident description with our offices. We provided you with the details of the other party who unsafely changed lanes and collided into the client making the accident unavoidable. Our client was not the proximate cause of the accident and we have suggested that you redirect your claim and claim form the other party. The claim you have against our client is a legal dispute and we suggest that you obtain legal counsel from an attorney. Should you have your own insurance, for your ease of mind, maybe it would be safer to rather proceed with your claim through your insurance, have them repair the vehicle in accordance with their contract with you, and then have them submit a recovery against Discovery Insure. Any legal action taken against our client will be defended from our side. - In a nutshell they won't budge until I have the time and money to get a lawyer. This is how these fear profiting businesses work. It's ok though, justice prevails and I'm not making extended efforts to get legal counsel to represent me to resolve this matter. Once resolved I will update and share this HelloPeter post with the truth and the outcome of the truth.

Also, 3 cars were struck by the motorcycle, I was the last one, stationary when struck. The sod who couldn't afford premium insurance on his old car and as such has to wait for a payout. The argument is between the first collision parties. There is absolutely no debate as to my innocence in all of this, I just cant fix my car until they resolve the matter, which they won't until they notice a significant loss or potential thereof.
