Complaint Regarding Unfair Claim Rejection and Unauthorized Policy Changes

Dear Discovery Insurance,

I am writing to formally express my dissatisfaction with your handling of my insurance policy and claim. I feel compelled to raise this issue publicly due to the blatant disregard for fairness and professionalism in your processes.

Last year, I filed a claim for my insured MacBook Pro after its battery expanded, causing physical deformation to the device. The back casing was popped open, and the structure was bent due to the damage. To my dismay, you rejected the claim on the basis that this constituted “normal wear and tear.” It is incomprehensible how significant physical damage of this nature—resulting in a visibly deformed device—can be classified as “normal wear and tear.” This decision is not only unreasonable but appears to lack any grounding in good faith.

To compound the issue, I recently reviewed my policy document and discovered that the MacBook Pro has been completely omitted from my policy. This was done without my knowledge or instruction. Had I not noticed this unauthorized amendment, I could have been left unprotected in the event of a legitimate claim. It is deeply concerning that Discovery Insurance would make such unilateral changes to my policy, effectively shifting the onus onto me as the insured to discover errors or omissions caused by your own administrative actions.

Your actions not only breach the principle of utmost good faith inherent in the insurer-insured relationship but also expose a worrying lack of transparency and accountability. These issues may well amount to violations of consumer protection laws and insurance regulations.

I demand the following: 1. A written explanation for the rejection of my claim and how physical damage to a device is deemed “normal wear and tear.” 2. An investigation into why the MacBook Pro was removed from my policy without my instruction, along with evidence of any communication authorizing this change. 3. Immediate reinstatement of the MacBook Pro on my policy, retroactive to the date it was wrongfully removed.

Failure to resolve these issues promptly and satisfactorily will leave me with no option but to escalate this matter to the Ombudsman for Short-Term Insurance and consider pursuing legal action for breach of contract and consumer rights violations.

I trust Discovery Insurance will address this complaint with the urgency and seriousness it warrants.

It has been 2 days since your message, and I am yet to receive any feedback or resolution from your team. This delay is unacceptable given the serious nature of my concerns, particularly regarding the rejected claim for my MacBook Pro and the unauthorized amendment to my policy. I expect immediate action to be taken and a detailed update provided to me by close of business today If I do not receive a timely and satisfactory response, I will escalate this matter to the Ombudsman for Short-Term Insurance and other appropriate regulatory bodies. I trust you will prioritize this issue and avoid further unnecessary delays.

I repaired the Macbook at my own cost post the attempt to claim. A claim event does not warrant automatic removal of the item from my policy? The item should still be covered in the event of future loss or damage as per your own message above. Why was this automatically removed, and why was I not informed of this either?
