Better to have been seriously injured and rear end

On the morning of 25th Nov 2015 we were on our way to work,the highway was standing so we drove via Greenstone to go over Modderfontein road,when we joined normal traffic and signalled to go to the extreme right lane to go down Modderfontein road.After we joined the road my Finance screamed out for me to watch out,but before I could get out of the way we were hit from behind by Grace.She climb out asking us how did this happen,still holding the cell phone I assume she was talking on. then I tried to sort out a claim against Grace (***)driving a Black Jeep.I phoned to log a call,they send me paperwork to complete and add stuff.I send it on the 12th of Jan,only on the 18th after I emailed again to ask what is happening I got told that there are more info needed on the paperwork,I as well as the other passenger on my car filled in the paperwork.Again a week later I got an email they cant see where is the damages on my car I attached 7 photos and waited.On the 18th of Feb, the next month I got back :Sorry you changed lanes,you are wrong,even with an affidavit stating we were right,would have been better to have been hit from the back or injured then try to avoid an accident?
