3rd Party Claim Horror

June 2019, a Discovery Insure client rammed my perfectly drivable pick-up van from behind when it was stationary, packed next to my vegetable stall, rendering it not-drivable. 6 months later after lodging a 3rd party claim, Nonhlanhla Sinthumule, Legal Liability Advisor from Discovery Insure writes to advise me that "An owner is entitled to a sum of money (damages) which will place him in the financial position he would have been in if his vehicle had not been damaged. The object of an award is to compensate the owner for material loss, not to improve his material prospects. In other words the owner is entitled to claim his negative intersess (interest)." A drastically unfair and unreasonable settlement offer was made to me and when I requested a reconsideration, due to the fact that I no longer have a vehicle and the offer on the table is too little to replace the damaged vehicle, I am told there are no grounds to motivate for a reconsideration. My vegetable business has since collapsed due to lack of reliable transportation and I am seating here with no vehicle, through no fault of my own. Where is fairness and justice here?
