FALSE ADVERTISING

Between 23-10-2023 and 24-10-2023 an email was sent out that disgustingly misleads consumers. The email states the following: "We're entering a new era in 2024... Are you ready for it?

Moving swiftly towards 2024 - we're shaking off the year that was..."

Discovery has partnered with Big Concerts to promote the new music festival in South Africa, Calabash. Any semi educated person would know that the words used in that email all refer to Taylor Swift's lyrics or her directly.

Promotional content was posted to Facebook as well, where a user commented "If this is Taylor Swift, I will be opening up a discovery bank account" , to which the official and verified Discovery South Africa profile rep**** "Fingers crossed 🤞🤩💜"

This morning, 25-10-2023, the line-up for the festival was announced. No Taylor Swift.

Not only were there clear and concise references to her lyrics and likeness used, but also false user engagement implying she would be attending.

As per The South African Consumer Protection Act, no 68 of 2008, Right to protection against false, misleading or deceptive representations:

Suppliers are not permitted to provide false, deceptive or misleading representations regarding services and products.

It is not permitted to use innuendo, ambiguity or exaggeration when referring to products or the benefits thereof.

This is disgusting behaviour from Discovery, not to mention *******.
