used phone sold as new

<p>Good evening</p> <p>around october 2016 i was told about a deal Dion Wired Was having on the Iphone5s by a friend. I then went to my closest Dion store which is located in Hyde park corner, i looked at a demo, liked what i saw and proceeded to take on a contract. little did i know that i was buying a second hand/refurbished phone. at no time was i told/spoken/informed about the fact that what i was buying was a refurbished phone, i did tell the salesman named Lebo Phahlale that i heard about the deal from a friend/client/word of mouth therefore did not have the chance to read about any specifics on the iphone 5s deal. if i had known this had been second hand i would not have bought it, as now the device cannot pickup any signal, i have tried the sim card in another phone and it works fine, so i conclude that the phone is defective. i have brought this matter to the attention of the manager Donovan Norton who was in general less than helpfull telling me that salesman are not required to tell the customer that they are buying second hand/refurbished goods and that nothing can be done, i quoted the CPA act that states that an item bought from a merchant and is found defective within 6 months from purchase is entitled to a refund/replace/refurbish, he agreed to that and said i can book my phone in.</p> <p> </p> <p>In summary if i wanted a second hand phone i would of went to cash converters, furthermore i was not offererd to have my number ported or caller identity activated(had my phone for 2weeks thinking everybody is calling on private).</p>
