False Advertising and Rude Sales Staff
I went into Dion Wired Greenstone this morning and walked past their MacBook stand. They had a couple of deals advertised as Pre - Black Friday Deals with large orange and black signs in front of certain laptops, one being a Apple MacBook Pro 13.3" 128GB Retina marked down from R17999 to R12999. I asked one of the sales assistants if there was a limit to the number we could buy as I wanted to get three of them. He said no there is no limited on these deals and he would just go and check stock. He lifted the perspex holding down the deal description and price and took the price (as it had the model number) to the stores to check stock. He then came back and said no actually that price is a demo price so it is only valid for the one on display. Nowhere on the advertised price he was holding did it say anything about it being for a demo model, it simply stated the model number and the old and new price. The surrounding deals for demo laptops clearly stated in bold capital letters DEMO after the description. I told him that thats not what the price says, it doesn't say anything about it being for a demo laptop and he again insisted that the price was for the demo laptop even though thats not what it said. I then asked him why all of the other DEMO items in the shop clearly say DEMO on the price tag and this one didn't. He stared at me blankly, then said you can't get this laptop new for this price, put the price tag and description which he had just told me was incorrectly advertising the special BACK ONTO THE SHELF underneath the perspex and turned around and walked away and went and chatted to the two woman working at the cellphone section. No further explanation, no apology, no recommendation, just re - falsely advertised the product and walked away.
Section 23 of the CPA states that if a displayed price contains an inadvertent and obvious error, the supplier is not bound by it, provided they correct the error and take “reasonable steps” to inform consumers who may have been exposed to it.
Firstly this does not come across as an inadvertent or obvious error. The sign has the old price, the new price and the price difference or "SAVING" advertised on it. Secondly, there was no effort made to correct the error or reasonable steps taken to inform consumers who may have been exposed to it. The error was simply re-posted by the product for the next consumer to question.
I have photos of the advertised deal as well as the surrounding vastly different DEMO advertised deals if you'd like to see them.
We referred the matter to Senior Management who will investigate this matter and will contact you to discuss this matter.
