Dial direct no pay

I was involved in an accident, a drunk man skipped a red robot and drove into my car while I was stationery waiting for the car in front of me to turn. Now Dial direct say they won’t be able to fix my car it is better to write off. The car is not a write off and I asked them to give me my car and they must pay me what they should to fix my car. Now they say they won’t pay me because of gaps in certain months I was not insured with them but I ended up joining the insurance again. They are coming up with excuses to not pay me when I pay them every month and I’ve been sure of driving an insured car.
