Rejected claim

On the 13 June 2022, at Berlin near King Williams Town my husband's car was parked stationary when a moving truck(Designer Lighting) hit our car while I was inside the car as passenger .The driver stopped claiming he was trying to find his beanie(cap) and lost control and we called the police within few minutes they arrived and took the accident report. Apparently the guy had no Drivers or Learners License and he was not even an actual driver but a van assistant and he was with actual driver in the truck at the time of accident. The guy called his line manager he came and arranged our car to be towed to the nearest towing depot. We went to Legal Wise(I'm a member) so they can help us with the claim since we had no insurance for our car . They sent the claim to Designer Lighting and matter was referred to the insurance which is Santam, it was back and forth and it took long we issued every documents were required in the end Santam rejected the claim saying the client(Designer Lighting) never gave the guy a permission or authority to drive the truck so we need to claim straight from the driver. Legal Wise sent the matter to their MBA Department and it was a long draining process and we fought numerous times for the matter to be referred to an attorney. Finally last year 2023 August it was referred to the appointed Legal Wise network attorney. And the attorney did his stuff regarding the case, send summons and everything to go further with the claim. Last week I received an email from an attorney stating that they have been contacted by Santam representative about the follow up of the matter saying the driver was not permitted to drive the truck that day and has been dismissed from work , therefore the won't be a claim against their client(Designer Lighting) we should claim against the guy . Now this is confusing us because at the time of the accident the guy was driving their truck(Designer Lighting) with no legal papers to do so and we believe it is not our fault for them not to authorised him to drive now we have to suffer because of this negligence .All we want is them to pay for damages its their truck who hit our whether he was permitted or not that's not our responsibility. On the 26th April 2024 the attorney's office call us and ask for appointment this coming Thursday 02 May 2024 so we really do not know what will be the outcome as they already told us that we have to claim against the guy. Please we need help what should we do maybe someone had a similar situation we don't know anymore.
