maintenance court failing Kids and having them wait for what their needs to be met

I am writing this in hope of finding an solution to the system the department of Justice is using. Please help we have been at this for years have been failed by the department of Justice for a period of a year just for child maintenance increase

I am disappointed in having to wait 1 year and 5 five months to have the matter been discussed and heard by the magistrate on hand or on Duty

I am writing to complain of the poor and long service the Department of justice maintenance division Pretoria north and Mamelodi courts is providing

I went first went to apply for maintenance increase in November 2017.I was given a form to fill in and return to them with verified copies of the me the mother and the Child and verified proof of address. Documents were submitted on the 25-10-2017 and first court date was given for the 13-04-2018 which was 4months later and the file number was14/3/2-862/17

13-04-2018 which was wait of 4 full months from date of receive Val of documents. On the 13th of April 2018 I went to court and the father was not present at court. I had to wait half a day to be told that the sherriff who was send to submit the Summons could not find him. Another postponement date was given to the 10th July 2018

10-July 2018 the summons have still not received the designated place and a new court date of 06-09-2018 was given. I the resorted to having to do it myself since the sheriff working at the department could not find the r person. I took the summons to the nearest police station of his residential address and 3 days later the Warrant office from the police had the docs signed and stamped. I was then called to pick them up and go sop of at their court and I Quickly did that as requested.

At some point the court printed docs with wrong dates and I had to go back and forth to have them reprint the summons with a correct date

06-09-2018 On the day of the court the maintenance officer referred our matter to the magistrate on duty because my address had changed from Montana to Mamelodi and apparently they did not have the jurisdiction And told us to go to Mamelodi court with the dates 19th September 2018.to our arrival at the court both me and him were amazed that the court did not have the file and the matter could not be looked into.

I asked if it was possible for me to go to Pretoria court and collect the File and they agreed, I later came back whith the file and to my surprise I was told I had to reapply again as it was not their case in the first place. After a long tiring wait I nicely did that a resubmitted all the required docs on the 02-10-2018 and a new case was opened to be started from the beginning

02-10-2018 new case with file no *** was opened and another court date given of the 24-01-201-

While waiting a year for the matter to be called the Father went to the court and requested for the date to be moved further since he won’t be available in January 2018

A new date of 28-03-209 was given

I went to the Mamelodi court on the 24th October and asked if they can’t have the matter go to the Judge before the 23rd of November when the Father will be going away on work since the matter has been going up and down for over a year and if they can’t at least put an extra case on the cases they have. I was told to go speak to the father and see if he can’t agree for the increase if yes the we can come see the maintenance office

The problem is that I submitted all the documents as requested hoping that the law will assist in settling the matter for the child maintenance to be increased and to my dismay it take the Department tof Justice 1 year five months or more to have the matter been has been on the roll for 5 different dates.

19th October 2018 file not received and the matter not on the list. Courts did not communicate about the referral 24-01-2019 Now new court date is 28-03-2019 which is too far and unpleasant

I am disappointed in having to wait 1 year and 5 five months to have the matter been discussed and heard by the magistrate on hand or on Duty. And having to do the work that must be done by the employees of the department and being failed by them because I am a women. I am taking time off from work to attend the court cases and nothing is being done about the matter. I really feel I am being oppressed and my right as a mother who needs assistance is not being met

I seek help with getting a date before the leaves on the 23rd of November as both of us are available to attend court and have the matter resolved. I am very stressed as the child is going ti school and want the father to assist withheld of the child’s needs.

Please assist because the long wait is frustrating and not fair for the child and the child is not being put first on matter at hand. I don’t know how the courts work but a matter cant started from the beginning if it was referred by the Judge at Pretoria north otherwise he could have helped us and closed the matter without referring it to Mamelodi where it must wait on the Que again
