Urgent Accountability – Child Maintenance Case with Foreign National who is dodging the Court

To the Department of Home Affairs, I am writing to request Department of Home Affairs to help me to urgently follow up on my Child Maintenance Case ***/2023/102, involving a foreign national defendant. The defendant promised that once married and in possession of a South African ID, he would take responsibility for his child. Instead, he married another woman and has failed to pay child maintenance. I lodged this case with Child Maintenance in 2023 (second time). It took a long time to find the defendant because he provided false information about his residential address and income. He has skipped multiple scheduled court dates. Despite arrears, he continues to travel freely in and out of the country. The Child Maintenance file has gone missing multiple times, and hearings have been double‑booked. I am uncertain whether this case is currently under Section 10 or Section 31. I tried to seek help from the Presidency Hotline INC***. Each time I call to follow up, I am told the case is “under investigation” since December 2023. The child urgently requires these funds, including for essential expenses such as a Matric Dance dress.

On 3 June 2026, he promised that he is waiting for his PDP and then he will start by bringing his account up to date and then pay regularly on monthly basis, which he failed and did not attend court on July 27 becausehe went to Nigeria. I wonder if he will come to court on September 2. I respectfully request for onfirmation of the steps being taken to enforce overdue payments and for him to take responsibility for his child on monthly basis. This matter has already taken far too long. Further delays are unacceptable. I trust the Department will act swiftly to uphold justice and protect the child’s rights. Yours sincerely
