Inadequate Service

<p>I was under debt review with Adcap (Debt Safe) since September 2014. As part of their service they are supposed to deal with your creditors that want payments from you. I started complaining about a creditor that was harrassing me and they were supposed to have dealt with the issue. I decided to cancel the debt review and about a month later received a summons from the creditor they were supposed to have dealt with on my behalf. WHAT did I pay them for?? And now I can obviously get no reply to my many emails. </p>

I attempted to contact you but your phone went over to voice mail.

 

We have received a letter on the 3rd of July 2016 stating that you have app**** for the voluntary surrender of your insolvent estate. We have received your signed cancellation letter on the 12th of July 2016 whereby you confirmed that you decided to voluntary surrender of your insolvent estate. The Form 17.W was issued on the 19th of July 2016. Due to fact that you have cancelled your application, the bank has the right to enforce any legal rights.

 

The issue with the Nedbank credit card was nevertheless taken up with the Attorneys as well as Nedbank. In June we have received a counter offer from the Bank. The most important requirement in the process is that the final solution be reasonable to all parties involved.

Good day Heidi,

The voicemail you left said you would call again. I am still waiting.

Whether I cancelled the debt review process is irrelevant. The issue with Nedbank started last year already while I was still under debt review with Debt Safe. You were supposed to have dealt with this issus then.

Please send the counter offer as soon as possible.

Good day Nadine

I refer to our telephonic conversation of 05 September 2016.

As per the summons that you provided us with, please be advised that the bank proceeded in terms of Section 129 due to you currently not being under debt review.

If they proceeded with legal action while being under debt review they would have proceeded in terms of termination, Section 86(10).

The matter would have been resolved as we did receive confirmation from Nedbank that they declined the offer and thus entered into further negotiation.

Good day Heidi,

What do you mean I am not under debt review? I started making payments to Debt Safe since 01/10/2014. What exactly did I pay Debt Safe for? The summons is dated 7 June 2016, while is was still under debt review and paying. My cancellation was only on 12 July 2016.

According to my credit report I have been under debt review since 01/09/2015.

I am still waiting for you to send me the counter offer. Why was I never informed that Nedbank declined the offer???

Creditor harassment while under review is common. All our clients are warned against this behaviour when they apply. We are however able to assist in all matters successfully.

As explained to you telephonically on 05 September 2016, the bank declined the offer in June 2016 and you informed our offices on 3 July 2016 that you want to voluntary surrender your insolvent estate for sequestration, and therefore we did not further discuss the declined proposal with you or negotiate further with the bank.

Unfortunately, due to the fact that you withdrew from the process, we cannot assist you any further.

My name is Nadine.

I still don't understand why you would not forward me the letter from Nedbank which you received in June. I only cancelled the debt review in JULY.

I am not surprised that you don't want to assist me despite taking money from me for almost 2 years. For 2 years I have heard nothing but excuse after excuse about Debt Safe not being able to perform the services I paid for. So I am really not surprised by you response.

I really hope potential clients will reconsider using Debt Safe as a preferred service provider.

Good day,

Further to my first complaint I would like an explanation as to why Debt Safe stopped paying Edcon in February 2016 and then resumed in June 2016. The only reason I noticed this because I still get my Edgars statements and they haven't received payment from February - May 2016. No wonder they started harassing me.

According to the certificate of balance from Edgars the amount was: R8,626. I was told by Ms Dube that the amount was paid up in December 2015 yet the payments to Edgards resumed in June 2016. How is that possible? I would like to know why the payments were stopped.

I demand that Debt Safe contact Brooks & Luyt Attorneys and explain this to them so that they will stop harassing me. Whether I have stopped debt review now is irrelevant because this problem started while I was still under debt review.
