Debt review mismanagement
<p>I joined Debt Safe in July 2011. In 2015 I performed an account recon based on a Hyphen statement that was incorrect. It took me 3 months to get all the paid up letters. During this process I uncovered creditors that were over paid resulting in refunds. Some of these creditors where over paid for a period of up to 6 months. When I asked Roxanne about it, the response was vague and eventually an admission of mismanagement. That money could have been distributed to other creditors that were charging interest, but I was told that it would not have made a difference and I agreed to the payment plan. I never agreed to over paying creditors, I agreed to settle the debt. A year past and I get another call informing me of yet another refund. At this point I was under debt review for 5 years and 2 months and no where near settling 2 creditors. Everyone knows that you should not be under debt review for more than 5 years. I decided to cancel the debt review, informed my relationship manager of that decision and communicated and made arrangements with 2 creditors. Still, the documents sent, the communication from Debt Safe is incompetant and I am still listed as under debt review from the Credit Regulators. I just want to get rid of Debt Safe. They are incompetant and prey on the bones of the over indebted. Be careful of this company, once you are in and under debt review, they will keep you there, regardless if you pay them or not.</p>

On 12/05/2015 it was cleary explained how interest and fees are dealt with in debt review and the explanation could not have been vague as you responded that you understand and that it makes sense. I also explained that the balances indicated on the Hyphen statement are not correct and Hyphen has indicated this on their statements to prevent any confusion. You based your recon on the Hyphen balances which were not accurate.
Please be advised that the accounts that had refunds were mostly your medical accounts (Doctor’s bills) and the payment plan was calculated on the balances that you provided in your application form. The balances you provided were more than the actual balances therefore the accounts were over paid.
The amount you pay towards your debt review is calculated according to your affordability, according to a budget that you complete. Please understand that we can only pay the creditors with the funds that you have available.
The ideal scenario is to calculate a payment plan to solve within five years but please understand that this is not always possible if the funds available is not enough.
In a recent High Court decision and a subsequent directive issued by the National Credit Regulator, it was ruled that a Debt Counsellor cannot withdraw from a consumer nor can a consumer withdraw from a Debt Counsellor unless the consumer is rehabilitated or transferred to another Debt Counsellor.
This implies that you remain on the data base of Debtsafe and “flagged” under debt review unless one of the following occurs;
Either request to be transferred to another Debt Counsellor
Re-activate your application with Debtsafe on the terms and conditions that will be explained to you
Once all your debt has been settled then you can send us paid up letters and a Clearance Certificate can be issued.
Please kindly be advised that your debt review has been terminated (our services have been suspended) and the Form 17.W was issued on 15/12/2016.
I am sorry you feel this way about debt review as this process has help so many other people. We do what we do because we have a real passion for people in need and find it extremely rewarding to guide those in financial dire straits towards a workable solution.
