Breach of in duplum rule
I have been under debt review since 2013 and all went well until I noticed that accounts were going into arrears. Furthermore, the repayments were structured in a way that it did not satisfy the minimum required payment for the accounts.
Needles to say, 9 years down the line, and my Standard Bank account grew from R22345.00 to R74766.00 and DebtSafe is not showing any effort to represent me in the manner I thought they would. The creditor in question is in breach of the in duplum rule which is meant to protect me from infinite interest being charged while in default of payment, and all DebtSafe does is try to convince me that all is as it should be.
I have had to stay in contact with creditors directly to stay informed of balances still outstanding otherwise I would have just continued paying those accounts while they were already paid in full. I have also had to request paid up letters myself and with more success that the company who is supposed to deliver this service.
It is demotivating to know that I will need to continue fighting the battle by myself, while I am being met with smoke screens from DebtSafe.
