Refusal to give me a withdrawal court order

Very frustrated with DR. I joined debt rescue earlier this year, then shortly after joining and before the initial payment to PDA I decided that I no longer want to continue with debt review and I communicated this at a very early stage and requested a withdrawal court order in less than a month of joining. I have not received what I requested, instead I get communications of the company saying they are suspending their services because I refused to cooperate, notice of terminations and communication about sequestration which I fail to understand because every debt that was listed is up to date some are settled as I was making direct payments to these debts. I did not pay PDA because I communicated that I want to withdraw at a very early stage.The frustrating part is all this could have been avoided as I communicated my intentions of not continuing with the process at a very early stage but debt rescue ignored this communication and insisted on keeping me hooked without my consent to continue with the process. I still demand withdrawal court order so that I can move on with my life. And I am not talking about the 17.W that you keep sending me as that form has false information that I refused to cooperate, I want a court order letter stating that I withdrew from the process.

I have investigated the matter and would like to provide you with clarity, as some of the statements in your review are not fully accurate.

You joined Debt Rescue on 28/02/2025.
  • A 17.1 notice was forwarded to your creditors, advising them that you had app**** for debt review.
  • Certificates of balance were received from your creditors.
  • A 17.2 notice was issued, which declared you over-indebted.
  • Your first request to withdraw from the debt review was received on 25/04/2025, which was already two months into the process.

As per the NCR rules and regulations, once a 17.2 notice has been issued, you are officially declared over-indebted. The debt review flag can only be removed once a court has declared you not over-indebted. For this application, you will need to appoint your own attorney. Once the court order is granted, please forward it to us so we can update the NCR system accordingly.

With regard to the 17.W document, this is a standard document issued by the NCR. We are not permitted to amend any details on this document.

Please also note that, since the inception of your debt review application, no payments were received from you.

This is not correct the initial email was sent to *** on 26/03/2025 communicating my intention to withdraw and on 25/04/25 was the 2nd time I communicated that I want to withdraw and the matter was still not in court at this point as I still had to sign a proposal form which I did not sign and the on 05/06/25 Lindiwe sent me an email stating that my file is ready to be sent to attorneys to commence a debt review court application, meaning the matter still hasn’t made it to court at that time and I continued to communicate that I did not wish to continue with this process and DR continued to ignore this request like they did with the 2 previous requests they went MIA. If debt rescue is failing to rectify this matter I am going to proceed to report the matter to NCR then we will see how this matter turns out.

In addition to this if you are saying it was two months in debt review why did no one never rep**** at that time why did debt rescue then continued with the process and went to court even when I told you I want to withdraw because as much as you are saying I was two months in the process I don’t believe that is the valid reason because the matter wasn’t taken to court at that time so withdrawal was very possible as nothing was granted by court and my file still hasn’t reached the attorneys on 25/04/25 my file was only got ready 05/05/25 which was enough time for debt rescue to drop everything. In simple words 2 months means nothing if court never granted anything and communication to withdraw was done before court.

The file did not go to court.

As per my previous communication to you the 17.2 was issued 2 weeks after you have joined debt review - this has declared you over indebted.    This gets issued when the interim proposal was forwarded to the creditors  - within 14 days of application
