In a worse position than before
I app**** for Debt Review in 2016 - and Debt Rescue made contact with the creditors and negotiated the new instalments etc. Payments have been made to the likes of Hyphen PDA as per the agreement that was signed in 2016, and have been distributed accordingly. It has now come to light that Debt Rescue has not obtained a court order for the said accounts, leaving me in a worse position I was in to start with. I received an email from Bayport regarding this and they came back with the following: • According to our records you went under debt review in September 2016 with NCRDC number **** • Bayport included both your loan reference ******* and loan reference ******** under debt review, the certificates of balance were emailed to your debt counsellor on the 16th of September 2016. • Outstanding balance at the time on loan reference ******** was R 3,907.45 @ 32.10% interest charge and on loan reference ********* it was R 14,994.92 at 35.40% interest charge. • On the 29th of September 2019 your debt counsellor sent Bayport a payments proposal of which Bayport responded with acceptance letters on the following basis; o A monthly instalment of R 122.88 on loan ****** for 36 months at 2.30% on provision of a granted court order o A monthly instalment of R 452.84 on loan ***** for 40 months at 2.35% on provision of a granted court order • On the 29th November 2016 your debt counsellor issued a court application, stating that your matter will appear in court on the 10th February 2017. However, till today Bayport does not have record of receiving the granted court order. • Due to non-receipt of a granted court, Bayport did not restructure the accounts and your accounts were charged interest at contractual terms. • In 2018 April your accounts reached Induplum and Bayport stopped all charges • In December 2018 the PDA stopped distributing payments onto your account and Bayport terminated them from debt review
Debt Rescue came back saying
Good day, Hope you are good. Please note we have not received the court order as yet. Kindly note you can always restructure using the final acceptance letter but once received we will send it to you
I am now in a position of wanting to settle my accounts in full - according to the amount showing on my PDA statement, which I cannot do due to the above. +/- R3000 that shows on my PDA statement to the amount Bayport are willing to settle differ drastically!
