Warranty not upheld

Bought a pair of ear phones a week ago and the lid of the case has snapped off I was I formed that this is wear and tear and the warranty does not cover that - a week old and it's wear and tear ? Absolutely pathetic customer service how does one week of use constitute wear and tear
