Rental Deposit
In 2012 I moved into a unit in a complex in Brakpan and the agents were De Lucia Brakpan with which I had a contract until I moved out on 30 June 2018. My Contract stated that my rent INCLUDES water and electricity which was never the case. Then in +-2-3 years ago out of the blue I received a threatening letter from Jawitz Properties to cut my electricity. The bill was for R15000 +-. I went to see Jawitz who said that they are now the Principle Agents for the electricity and water and we have to pay them and my rent I still have to pay to De Lucia every month. We never received any letters or notification from either agent to inform us of these changes which to my knowledge is *******. I told Jawitz that I don't have the money to pay for this bill and never heard from them for about a year then all of a sudden I get slapped with another account and it would be +-R8000 and threatening to cut my electricity again. When I asked for the Municipal Account showing that I'm in arrears they couldn't give it to me. The last time they cut my electricity in May 2018 I went to see the owner Of Jawitz, but I pay the account every month. I told him that I don't have a contract with Jawitz and it is ******* what they are doing and he shouted at me and said that he is the Body Corporate and he can do as he pleases and he doesn't have to have any contract with me and I must stop being ********. At the end of May 2018 I received 1 months notice from De Lucia saying that the unit was sold. In the meantime in January 2018 when an Investor, a guy from Absa and an Agent from Jawitz came to look at our unit he said to me that the Investor is buying but NOTHING will change, they will just transfer my deposit from De Lucia to Jawitz and everything will stay the same but this didn't happen as the Investor was turned down by the bank. Speaking to the other tenants in the complex it came out that when an investor buys a unit then Jawitz wants another deposit from the tenants even when their deposit gets transferred to them from De Lucia. Now De Lucia says they received instructions from Jawitz not to give me my deposit back because of the large amount owing by me for the water and lights. The last and final account I received from Jawitz was R567.42 with no arrears or anything on it. Strangely De Lucia was not aware of me being in arrears with Jawitz but on the 28 June Jawitz sent De Lucia an account saying that they must not refund my deposit. They forget that I lived there for 6 years and my Deposit has accumulated interest as well. We have no ties tying us to Jawitz and when we returned the keys to DeLucia it came to them as a shock that we had moved but they gave us notice a month prior to us moving. According to De Lucia Jawitz asked if they had extended our contract to which they said they didn't respond because due to the unit being sold. Once we vacated they then got back to De Lucia asking didn't they extend the contract. It is clear to me that both parties are guilty and they are unfortunately known for not wanting to refund deposits which is not allowed. How can one pay for a deposit in a place where you are not living, because this is what this "OUTSTANDING ELECTRICITY BILL" is actually for? ????
