Refund from Damelin/Educor obtained

I finally got my refund after waiting years. Just want to share my experience in the hope to help others in a similar situation.

I waited years for my refund. My friend (attorney) and a few others advised me on the procudure. If you conatced Damelin for your refund and if the institution gave you a refund date and you still did not receive the refund. Yu must follow up. If you did and they gave you another date and you waited and they still did not pay, then send Educor refund dept an final demand request. That is an email stating the amount they owe you, the refund dates they gave you and they did not pay. Give them 30 days to refund you. State that should they fail to refund you, you will be taking legal action. Once 30 days of sending the final request have passed and they still did not pay, then you have to take this matter to the small claims court, if the refund is of R 20000 or less. Get a letter of demand. You can go to the one in town for this letter of demand. You will then complete the letter and hand deliver it to Educor which is in Pinetown. You can also ask the staff at the small claims court what the procedure is. Eventhough Damelin is in Overport, Educor is in pinetown, tahts the head office. Make copies of that completed letter of demand. When delivering the letter, get the receiver to sign one copy and you keep that copy. Thereafter you go to the police station and write out an affidavit. The affidavit is about you delivering the letter of demand to Educor. Educor thereafter has 1 month to refund you. If you do not receive it by then, go to the small claims court in Pinetown because Educor is in Pinetown. That branch handles this matter. Inform the staff about the situation. They will then do a summons letter. Explain to them that Educor is a private institution. I had an issue where one of them misunderstood thinking it was govt institution and they said they do not handle govt matters. One lady also said that Educor has to be registered with the dept of higher education, which is govt, therefore they cannot handle this matter. Another lady working there knew her job and said they can issue a summons because it's a private institution. They will give you the summons letter to take to the sheriff and a date to come to court. There is a fee. I think it's R500 or R550 you pay at the sheriff's office. You must deliver it to the sheriff on the same day. Carry cash because they don' have card facilities. The summons letter to deliver, you have a copy because the small claims court gives you two copies, one for you and one for the sheriff. Your copy must be signed and stamped at the sheriff's office. I got my refund before the court date. If you don't , you must go to the sheriff's office before your court date to collect the proof that the sheriff did deliver the summons letter to Educor. you must take that with you on the day you have tp appear at the small claims court. Also, write down all the attempts you made to get your refund. So date, day, time, all correspondences. you will need all that info when you represent yourself.
