Breach of contract

Please note that this matter of the fees for 2024 has been handed over to my attorney's office. The student left in the first quarter of 2024, and Damelin was advised.

We will be asking for a full refund for 2022 and 2023 as the student is unable to complete this qualification due to issues experienced by Damelin through no fault of the student.

During the first quarter of 2024, as well as parts of 2022 and 2023, Damelin has been in breach of student contracts due to its abrupt campus closures, failure to provide services such as classes and exams, as well as the inability of campuses to provide adequate access control and safety for students.

The South African Department of Higher Education and Training (DHET) formally deregistered Damelin in March 2024 for severe compliance failures. The complaint will be directed to this body as well as the NCC.

Key issues:

Deregistration: The DHET cancelled Damelin's registration because it failed to submit required annual financial statements for 2021 and 2022, which is a contravention of the Higher Education Act. This left the institution unaccredited to offer certain higher education programs, directly impacting the value of the service promised to students.

Operational Failures: Students reported numerous complaints, including a lack of proper administrative support, poor quality of teaching, lack of lecturers for key modules where students were directed to self study.

Abrupt Closures: Campuses, such as the one in Randburg were shut down abruptly due to the lack of utilities such as running water and electricity. Students were pushed to distance learning via online classes, a clear violation of the contract terms for the provision of educational services. The Randburg campus was eventually closed permanently with no notice to students. Students were apparently redirected to the Pretoria campus which makes no sense for students local to the Randburg area.
