Christmas gifts not delivered

I placed my order on 04/12/2015 with assurance that the gift will be delivered by Christmas. I followed up on the gift on 23/12 to which a huge furore was started with promises that the gift would be delivered.
Still no gift.
Yesterday Rene once again promised to follow up with no feedback.
So essentially, I'm getting the run around for my money and I'm paying the costs of this runaround.
I don't even know how to react in such a situation. I don't expect a legit business to decide to just not give me what I paid for. It doesn't make sense.
Is this legal? Can Consumer Protection be used in such instances?
