STILL AWAITING CLAIM REFUND AFTER ALMOST 3 YEARS

On the 21st of October 2018, I started the process of claiming back the excess I paid for an accident that was not my fault. I have the photo evidence, the accident report and an admission of guilt from the man who ran a red light and drove into me. The amount is approximately R4300 -00 which is a lot of money to pay for an accident that was not my fault. I have been getting the same story from the lawyers at customer loyalty, and they have now completely stopped replying to my emails which I feel is highly unprofessional.

According to my recent research Customer Loyalty 3rd party claims should be resolved and paid out within 21 days... Well they are clearly in breach of their own contract because I'm heading very close to 3 years now.

The complaint of Mrs Botha (“the insured”) has been received and referred to our appointed attorneys of record who has made telephonic contact with the insured. Judgment was obtained against the Defendant and the warrant of execution has been submitted to court for issuing.

Excess is the first amount payable by an insured individual under a policy of insurance when a claim is lodged with an insurer. Although an attempt is made to recover excess by inclusion in the insurer’s subrogated claim for damages against third parties responsible for damage to insured vehicles, success and turn-around time are not guaranteed as these are influenced by external factors such as a third party’s financial status and the court process in general.

Mrs Botha’s complaint refers to the 21-day turn-around time applicable to third party claims instituted against policy holders. The recovery process in this particular matter deals with the client’s own damage claim already settled by the insurer and not that of a third party claiming against the insured.

The insured has been appraised of developments and further updates will be communicated to the insured.
