Refusal os showing evidence

Good day Sir

I am Ms Portia Mtontsi the parent of Imange Mtontsi that is a learner at the Curro fores****. On the 17/09/2025 I received a call from Mr Matshikiza that is a educator at the Curro fores**** that there was a cellphone that was taken from the bathroom and Imange was one of the boys that was seen coming from the bathroom and he needs to come to school the following day to write his statement. The following day I was called again by the same educator informing me that they have viewed the footage and Imange is seen having something in his hands when leaving the bathroom and he was then suspended.They then changed their statement saying that they can see its a cellphone. I asked to see the footage and I was told that they are not allowed to show me because of the POPI ACT. I then asked them at what point do they consider the POPI ACT as Imange lost his beanie earlier this year and he was shown the footage of who took it and the boy was confronted and allowed to give Imange his beanie back, Mr Matshikiza then promised me that he will make a request to the headoffice for them to show me the footage and he never came back to me after that. I emailed Mr Mushaya who is the disciplinary head as per the hearing letter asking if the request for being shown the footage was approved and he did not know. The day before the hearing I spoke to Mr Mushaya and he said that Imange could have said that he had a calculator in his hands and I asked myself did they not say the video is clear.On the 30/09/2025 we attended the hearing and the chairperson who is also an employee of the Curro holdings found Imange guilty of *****ing the phone based on their evidence being the footage that I was not allowed to see.The chairperson went as far as saying that we should just trust him that he will never lie about seeing the evidence. I was given an opportunity to apppeal to Mr Ross and I did but the outcome was exactly the same,he did not acknowlegde the facts on the appeal letter being that I feel my child was unfairly dismissed as I was not given an opportunity to see the evidence(being the footage). My child is a grade 11 learner that is sitting at home now while the exams are starting on the 24/10/2025
