CSOS not on your side and blocks you from using lower courts/small claims court
Terrible Service from CSOS Western Cape. I would strongly advise those who cannot afford to go to court to stay away from them, as they did a very bad job both procedurally and in terms of handling my case, and after they are finished with you, you cannot go to small claims court or any magistrates court, you are forced then to spend an absolute fortune on the highest courts to Appeal their 'decision'. The most shocking parts of my case were (1) I had to follow up constantly to get them to progress my case, (2) after being given an adjudicator, it was about 4-5 months before they actioned anything, and my adjudicator mysteriously changed before 'my hearing', (3) one hour before 'my hearing' via Zoom/video call, I was sent an e-mail notifying me that they will no longer have my hearing and that I had to send in a written submission!! (HOW CAN ONE NOT GET AN INTERACTIVE HEARING???? (4) After sending my written submission, nobody contacted me at all to clarify anything, and after waiting and waiting for someone to call me, I eventually sent a follow up e-mail. Over a month after the written submission, the Adjudicator sent me an e-mail with the decision, which said I have one month to appeal, this after the month had already expired!! (5) I sent the adjudicator an e-mail asking her about the appeal date and the fact that I received the decision over a month after the 'hearing' and she basically responded with no commitment at all or taking any kind of responsbility for failing to send me the decision on time. (6) I requested to speak with her to clarify her decision which made no sense, and she just simply never came back to me. The actual decision would not stand up in a court of law, but unfortunately I went the COSC route which now stops me from going to the small claims court or other affordable route!! I do wonder how the relationship between COSC and the management agents could be incestuous which may explain the very strange flaws in their procedures, and blatant lack of communication, not even affording me an interactive/proper hearing.
We do not want you feeling that way we aim to offer affordable and reliable services to all our stakeholders. Kindly furnish us with your Ref No and we will escalate the matter to the Adjudicator General.

Please give me the e-mail address to send the details to as I don't want to share my details publicly. Unfortunately though, as the decision has been made and there is no internal appeal process, you can however not assist me in fixing this, even if procedurally flawed from your side (especially with regards to the hearing being cancelled 1 hour before, and written submissions requested instead which stripped me of my chance to be heard properly, as well as the decision being sent after the appeal date expired). I would still have to appeal to the Appeal courts, which is very expensive and I do not have the money for such action, not to mention that the appeal date had already expired by the time you sent me the decision. :( There is no way for you to rectify MY situation, only for you to address your staff involved in this for future cases.
