CSOS Inconsiderate, Impartial, a Waste of Time and Resources. They side with Big Fishes (Companies)!
CSOS adjudicator, Lindiwe Bulo deliberately delayed in adjudicating my matter and handed down an order only on 28 April 2021, in the favour of the Respondent (Managing Agent Huurkor) on the basis that I sold the property and am no longer a member of the scheme. The merit of my application was never taken into consideration regardless of the fact that my Dispute was lodged in November 2019 while I was still a member of the scheme. It took the CSOS more than 16 months to finalize my case but had a quick appetite to come up with the order to dismiss my case days after receiving just a one-liner so called Final Written Submission from the "Blue-Eyed Baby", the Managing Agent on the basis that I am no longer a member while the property was only sold in June 2020. Also, the sad part is that you can only Appeal their ruling at the High Court knowing exactly that it means that one needs to have financial muscles in terms of Legal fees.

I believe that the question I asked above is reasonable and a fair response is sought as this was supposed to be looked at by the adjudicator before the case could be finalised. If indeed your services are affordable and reliable, why would you refer me to the High Court? I do not have legal fees to appeal at the High Court hence my cry.
Your process took a year and a half (17 months) to be finalised, a part of that period in which my dispute was lodged with the CSOS, I still had "material interest in the scheme" as all the levies including the CSOS monthly membership levies were all paid. Therefore, my case cannot be dismissed on the basis of me no longer being a member of the scheme and not having a "material interest in the scheme". I was a member of the scheme at the time of lodging this dispute.
If I wasn't a member of the scheme at the time, why did you make me pay for the Arbitration fee? You have run out of reasons behind the dismissal of disputes because you are hellbent on taking the sides of these managing agents and body corporates.

If the CSOS is impartial and does not take 1st respondent's side, then the CSOS would listen to my cry. But if the CSOS still stands with the adjudicator's decision, then I will humbly request that I be refunded all the levies I have paid from November 2019 (the period I lodged my complaint at CSOS) until June 2020 (the period the sale of the property was finalised) as I was still a full member of the scheme.
