CSOS - Absent ahead of an application.
I was hoping to seek a CSOS Order for my BC to meet 50% of Common Property costs before I initiated a project (R60k) and paid my 50% non-refundable payment. I now believe, in the absence of any reply from the CSOS regarding guidance, I would be trapped in a system designed to help but currently dysfunctional and potentially leading to substantial losses with no benefit for an owner on a budget.
If an owner cannot be confident of receiving accurate information in simply seeking a successful argument, what chance is there of having a case heard fairly when, based on past reviews and articles outlining failures in law, that cannot be overturned without an expensive appeal.
There is also the risk that if an order is granted a BC has the option to ignore as an enforcement of the order will incur addition costs for the applicant, effectively breaking his\her spirit with no option forward and thus deny enjoyment of his\her section, as the ST Act had intended.
I have plenty of evidence but risk is too high to be denied, when evidence can be ignored without any explanation.
For now I would advise all seeking recourse to carefully consider alternatives that won't deny an option for a cheaper appeal.
Only the wealthy can afford the gamble while others must chew the cud.
