Re-imburse R13000.00

I needed to secure a yard by installing a fence, and on the 12/02/2019 I received a quotation from a guy called Cyril Mkansi whom I found on internet that he installs fences. The quotation was R22.500. On the 19/03/2019 we confirmed on how and when to come and install the fence. Then I waited still comparing prices with other companies, I found that he is the cheapest and I contacted him again on the 09/04/2019 and he send another quotation of R23.000 together with the invoice stating the deposit amount of R13.000 and the balance of R10.000. On the 11/04/2019 I deposited R13.000 into his account so that the project can be started. Told him the money is deposited and he said they will start as soon as the money is cleared. On the 25/04/2019, we agreed to meet on the 27/04/2019 at 8:00 so to start with the project, and he did not come. Called him and send messages but no response. Same day at 13;26 received a WhatsApp message that says: [27/4, 13:26] Mkansi: We never communicate on WhatsApp I sent an email too I had few drinks last night and I slept early and I overslept I just woke up now dizziness and I was vomiting. I’m very sorry to all I put you through let me check my guys may be we can come in the morning to digging the holes. [27/4, 13:26] Mkansi: Cyril On the 28th and 29th of April I send him messages and emails but he did not respond and I said to him: Good morning Mr Mkansi. I am so disappointed in you. I chose you out of so many people to come help and supporting Black business but I guess I made a very BiG mistake.

Since you could not do what we agreed upon...can you please reimburse the R13 000 deposit back to my account...I will supply you with my banking details shortly.

He responded on the 30th apologizing and willing to come do the Job, we agreed and he finally came, show him the site and do measurements and found out that I gave wrong measurements and he said he will do the revised quotation. 02/05/2019 received the revised quotation of R31.000. I told him I cannot afford and ask him to reimburse the R13 000.00 deposit. He agreed. On the 6th of May I reminded him to pay back and he said end of May. Early June I called him he answered and told me lot of stories and promise to pay. On the 24th of June I called, send sms but he did not respond. 12th June send him sms suggesting that he can pay me R3000.00 from end of July, and R3000 end of August, and R3000 end of September and then end of October the remaining balance of R4000. He did not respond. On the 16th July I asked him to answer me and he responded and said: OKAY. 30th July send him sms to remind him about our agreement he did not respond. Today the 31st, send him email telling him my banking details did not change. Waiting fo his response.

What should I do because it seems he will never give back my money, PLEASE HELP!
