Does the CMS exist to protect consumers or the medical schemes?

I recently discovered that Discovery Health (DH) had been deducting a "select benefit" charge as part of my Classic Comprehensive total amount. It was never shown on any invoice, statement, website, etc and was therefore invisible until discovered by chance. DH cannot provide any evidence that i ever ageed to this charge being added to my plan and is therefore clearly a mistake on their behalf. Their only pathetic defence was that i had made 2 claims in the past couple of years and therefore i had used the benefit and was not entitled to a refund. The issue is that the benefit related to childbirth, which only happened +-18 years after i supposedly took out the benefit. I was also single at the time of this benefit being added to my account so clearly i would never had added a childbirth benefit when i was single and had zero chance of benefitting from the "benefit". All efforts to try and resolve with DH went nowhere so i lodged a complaint with the CMS.

After +-150 days of doing very little it appears the CMS used the same lame claim logic as DH and thereafter refused to respond to any form of communication, including my request for review/appeal, which is governed by section 49 of the Act. It is therefore clear to me that the CMS is a smokescreen set up to appear to protect the consumers but in the end merely protects the medical schemes. What a farce!
