False Pricing

<p>I have a problem with my recent purchase on Bid or Buy.</p> <p>I saw Wifi Camara system on Bid or Buy For R334.79 and decided to buy them on 26/07/2017 and take a chance cause there is always Big Bargains on Bid or buy.</p> <p>I Paid for the System Through PayPal. I send an email to ********** on 27/07/2017 To confirm that they received my money. Later that day I send another email cause they never rep**** to the first email.</p> <p>I went back on my Bid or Buy profile and viewed my Orders and saw there’s a Cell number, so I phoned them cause they are not responding to my emails.</p> <p>A man picked up and said he is currently driving, he said he did receive my email and Payment thank you, and he said he will reply on my Email.</p> <p> </p> <p>On Friday 28/07/2017 at 08:50 I Called him again cause he never rep**** like he said he would. He said there was a mistake on the price given on the Bid or Buy add?? And didn’t want to give it to me anymore and I have to</p> <p>Pay extra cause the price isn’t right. I said im not gonna do it, cause its not my fault, they received my money and I bought it for the price it was advertised for. He said he will call me back at 13:00 with an answer.</p> <p>On that same day at 14:56 I called him cause he never tried to come back to me. He said he will send the tracking number to me on Monday 31/07/2017.</p> <p>On Monday the guy i spoke to on the phone send me an email saying "This mail serves to inform you, as telephonically discussed, it will not be possible for those type of cameras to be sold at that price. There was an error on our side and it was rectified you can now buy at a full price or we can refund you the money already paid."</p> <p>I decided to take up this issue with the Bid or Buy customor Care. they rep**** today 01/08/2017 saying : </p> <p>"Thank you for your email.</p> <p>Please note that as per the sellers reason given that there was an error on there side with the price , they can choose not to sell the item<br />for the price you paid .</p> <p>Section 23 of the CPA states that if a displayed price contains an inadvertent and obvious error, the supplier is not bound by it, provided they correct the error and take “reasonable steps” to inform consumers who may have been exposed to it.</p> <p>- The corrected listing price is displayed for R7, 334.79 and your listing displayed a price for R334.79 , we can conclude that it was a human error on the sellers side for not including the 7 on your listing.</p> <p>The seller needs to refund you for the amount you paid immediately and you can rate the seller negative"</p> <p>I looked up the CPA Acts and in Section 30 it states "</p> <p>Consumer Protection Act, 2008 (Act No. 68 of 2008)<br />Chapter 2 : Fundamental Consumer Rights</p> <p>Part E : Right to fair and responsible marketing</p> <p>30. Bait marketing</p> <p> </p> <p>1)<br /> </p> <p> </p> <p> </p> <p>A supplier must not advertise any particular goods or services as being available at a specified price in a manner that may result in consumers being misled or deceived in any respect relating to the actual availability of those goods or services from that supplier, at that advertised price.<br /> </p> <p>2)<br />If a supplier advertises particular goods or services as being available at a specified price, and the adverti*****t expressly states a limitation in respect of the availability of those goods or services from that supplier at that price, the supplier must make those goods or services available at that price, to the extent of the expressed limits.<br /> </p> <p>3)<br />It is a defence to an alleged failure to comply with subsection (1) or (2) if—<br /> </p> <p>a)<br />the supplier offered to supply or procure another person to supply a consumer with the same or equivalent goods or services of the kind advertised within a reasonable time, in a reasonable quantity, and at the advertised price; and<br />b)<br />the consumer—<br /> </p> <p>i)<br />unreasonably refused that offer; or<br />ii)<br />accepted the offer, and the supplier has supp**** or procured another person to supply the goods or services so offered and accepted.<br /> </p> <p>Section 30 says this: “A supplier must not advertise any particular goods or services as being available at a specified price in a manner that may result in consumers being misled or deceived (about) the actual availability of those goods or services from that supplier, at that advertised price.</p> <p>“If a supplier advertises goods as being available at a specified price, and the adverti*****t expressly states a limitation in respect of the availability of those goods, the supplier must make those goods or services available at that price, to the extent of the expressed limits.”</p> <p>Now, under the CPA, the displayed price has become a binding offer, that becomes a binding contract once accepted by a consumer making payment" And i made the payment and they received my money!</p> <p> </p> <p>Bid or buy repleid with their final Mail saying: </p> <p>Thank you for your email.</p> <p>I dont think that the seller was misleading in any way with regards to the error in pricing , as per the CPA section s you mention:</p> <p>- The item is available for sale still , however the price was incorrectly entered on the listing as a human error.<br />- There is no huge difference between the price you had on your listing and the original listing displaying now , it clear that the seller missed <br />the ' 7 " when typing in the price.</p> <p>I dont believe that the seller was misleading in any way regarding the pricing of this item . It would be a total loss to the seller should the item be sold<br />at the price you bought it for , from the actual price it is worth .</p> <p>Trust that this is in order.</p> <p>Please provide me with your banking details in order for the seller to refund you"</p> <p> </p> <p>This is unacceptable! </p> <p> </p> <p> </p>
