Prescribed Debt
On the 18th of January 2016 I received an sms stating that I must contact Dikeledi *****ya regarding my account with Body Lab gym. I called her and she said I owe R16000 on the gym account. I then requested her to send me a default statement because as far as I know I asked for the gym contract to be cancelled but wasn't helped. Till now I haven't received that statement of which I also called today requesting the same. This account was opened in 2010. I have never acknowledged this debt for the past 3 years and the creditor didn't summonsed me for this debt and also there was never any emolument attachment. According to the prescription act 68 of 1969 if no payment was made on an account for 3 years and no summons has been issued for that debt within the last 3 years, then the debt is prescribed and I am not legally bound to repay it. Why now after 5 years is Flemix contacting me for this debt?
