Dispute of a void and deliberate misrepresentation of information of a contract

Hello Peter

Late last year In August I bought a phone online, it was an upgrade to be precise, I got a call from online sales, the deal I could not resist, it goes as follow: A cell phone huawei nova 11 Blue colour Comes with a smart watch at a value of R4500.00 R329 a month 36 Months contract. R149.00 airtime 200 SMSs The phone was to be delievered within 48 hours but it took a month to arrive. On delivery No watch was delevered whatsoever The colour was Black, no explanation The premium was now R449.00 1 gig of data 50 minutes

I lodged a dispute in September they promised to collect the phone and change it but never collected, they insited for them to change the package I need to bring back the phone and to my surprise two weeks back they have since migrated the contract without me having to return the phone. I had to stop paying them for them to attend to my dispute but after nine months of no communication. They are silent on the watch they promised me, actually I only agreed with the sale because of the smart watch. I am now disconnected for two weeks no one is talking to me. Remedy I need the watch of same value as at a point of sale Take responsibility for the outstanding fees Unfortnately I have two contracts with them which they combined and it is also affected. As far as the law of contract is concerned this contract is void and *****ulent. I want my profile cleaned up and be eligible to take up another contract as and when I want to do so. I further want a proper and appropriate apology for the suffering they have put me on for the past 9 months. I wrote to them several times with no response, I called them several times no help. Hello Peter is my last hope as I am being bil**** by Vodacom. Thank you in advance
