Sale of goods underfalse pretence
I purchased 2 Hurricane cellphones from CNA on 27 Nov 2015. The sales consultant told me that she did not know if the phones has whatsapp functionality but that I could download the whatsapp application onto the phones. Based on what she told me I proceeded to purchase the phones. When my son tried to download whatsapp he got a message that javascript shd be installed. He tried doing that but got another message saying that its not possible. I took the phones back to the sales consultant on 30 Nov 2015 and tried to explain what the problem was. She told me to rather bring my son so that he can explain what the problem was. I took my son to her on 3 Dec 2015 and when he told her what the problem was she informed him that the phones cld not accommodate javascript. They however refused to refund or exchange the phones for phones thats capable of accommodating whatsapp. If i had known these phones were basically only to say hello & goodbye I wld never have bought it. The phones were Xmas gifts for my 2 elderly parents who just wanted to stay in contact with family & friends via whatsapp.
